Your Rights
All members of the Hilbert College community have the right to:
- Make a report to Campus Safety, the Hamburg Police Department, and/or the NYS Police or choose not to report;
- To report the incident to Hilbert College;
- To be protected by the institution from retaliation for reporting an incident;
- And to receive assistance and resources from Hilbert College.
In accordance with the
Students’ Bill of Rights, reporting individuals shall have the right to pursue more than one of the options below at the same time, or to choose not to participate in any of the options below:

These counseling and health services are confidential and free for Hilbert students. Immediate contact with a counselor can be arranged through Campus Safety if a situation occurs after hours or on weekends.

Please note that these hotlines are for crisis intervention, resources, and referrals, and are not reporting mechanisms, meaning that disclosure on a call to a hotline does not constitute notifying Hilbert College and will not provide any information to the campus. Reporting individuals are encouraged to additionally contact a campus confidential or private resource so that the campus can take appropriate action in these cases. Individuals who have been the victims of sexual assault are encouraged to seek medical attention immediately.
Report to Hilbert College
To disclose an incident to a college official who can offer privacy, please contact any Hilbert College faculty/staff member, including Resident Assistants. These individuals can provide information about remedies, accommodations, evidence preservation, and how to obtain resources. They will also provide the information contained in the Students’ Bill of Rights, including the right to choose when and where to report, to be protected by the institution from retaliation, and to receive assistance and resources from the institution. These college officials will disclose that they are private and not confidential resources, and they may still be required by law and college policy to inform the Title IX Coordinator about the incident. They will notify reporting individuals that the criminal justice process uses different standards of proof and evidence than internal procedures, and questions about the penal law or the criminal process should be directed to law enforcement or district attorney.
If you have experienced, witnessed or are concerned with sexual assault, sexual harassment, dating violence, domestic violence, sexual exploitation, stalking, or any form of sex-based discrimination, it is important for you to know that there are available resources to assist you with the care you or a friend may need. Reports will be investigated in accordance with
Hilbert College policy and the reporting individual’s identity shall remain private at all times if said reporting individual wishes to maintain privacy. If a reporting individual wishes to keep his/her identity anonymous, he or she may call the Title IX Coordinator anonymously to discuss the situation and available options.
You may withdraw your complaint or involvement from the Hilbert College process at any time.
Report to Law Enforcement
Any person may call 911 or Campus Safety for immediate safety assistance. Campus Safety can also assist the individual in making a report of a crime to local law enforcement. A victim of a crime is encouraged to, but not required to, report the incident to local law enforcement and pursue criminal charges. The criminal process and the College’s disciplinary processes are not mutually exclusive, meaning that an individual can either bring a complaint through the College or law enforcement, or both.

The Hamburg Police Department can assist in filing a criminal complaint and in securing appropriate examination, including by a Sexual Assault Nurse Examiner. The New York State Police Sexual Assault Hotline may also be of assistance in reporting an incident to law enforcement.
Confidentiality
Complaints of sexual misconduct are treated with the greatest degree of confidentiality possible. In all situations, confidentiality is maintained on a strict need-to-know basis. Confidentiality may be offered by an individual who is not required by law to report known incidents of sexual assault or other crimes to institution officials, in a manner consistent with state and federal law. Licensed mental health counselors, medical providers and pastoral counselors are examples of Hilbert employees who may offer confidentiality.
Privacy
Privacy will be maintained at all times. Privacy may be offered by an individual when such individual is unable to offer confidentiality under the law. College employees will not share private information beyond what is required or needed to comply with law or policy.
